How long will my personal injury case take to resolve?

how long do personal injury cases take to settle

It doesn’t matter whether you have been in an auto accident or other mishap: If you were injured due to the fault of another you are entitled to receive compensation for your damages. In many cases, insurance companies will attempt to settle your claim with a one-time payment that might sound good at the time but ultimately leaves you responsible for a significant portion of the final bills.

Folks who have been injured are often afraid that hiring an attorney may delay the process. However, just the opposite is true. A good attorney will help ensure you are receiving all the proper medical care you need before trying to settle your case. Beware of any attorney that wants to settle your case quickly. The reality is that your case will take as long as you need to heal and recover from your injuries.

Your focus should always be on your recovery, not on settling your case. Let your attorneys help advise you when it’s time to settle – you only get one bite at the apple so you want to wait until you are fully healed or can fully predict what kind of care you will need in the future.

If you are fortunate enough to only suffer minor injuries, it is possible to settle your case within months of the initial filing. If you are severely injured, or the circumstances surrounding your damages are extremely complex, it can take years to come to a final agreement.

Personal injury claims are bound by a statute of limitations, which means the period in which to file your claim is limited. In Colorado, you have three years from the date of the incident to file your lawsuit against the person who caused of your injuries. This gives you plenty of time to heal and seek all the medical care you need in order to get your life and health back on track.

We try to settle all our client’s cases without filing a lawsuit – as noted above, you have three years in Colorado to do this. However, not all cases can be settled and we do have to file lawsuits on some. If your case is one that requires a lawsuit, a lawsuit can take up to a year or more. However, we will be doing all the work and your involvement in the lawsuit will be sitting for a deposition and answering some questions. Of the cases that go to lawsuit, only a small percentage go all the way to trial at the end.

How long will your personal injury case take to resolve? There’s no set answer, but if the insurance companies are attempting to settle your claim for a portion of your damages, or are drawing the claim out to what it appears to be after the statute of limitations’ expiration date, Zaner Harden Law is here to help you recover your damages so you can recover from your accident.
