If you are fortunate enough to only suffer minor injuries, it is possible to settle your case within months of the initial filing. If you are severely injured, or the circumstances surrounding your damages are extremely complex, it can take years to come to a final agreement.
Personal injury claims are bound by a statute of limitations, which means the period in which to file your claim is limited. In Colorado, you have three years from the date of the incident to file your lawsuit against the person who caused your injuries. We try to settle all our client’s cases without filing a lawsuit – as noted above, you have three years in Colorado to do this. However, not all cases can be settled and we do have to file lawsuits on some. If your case is one that requires a lawsuit, a lawsuit can take up to a year or more.
However, we will be doing all the work, and your involvement in the lawsuit will be sitting for a deposition and answering some questions. Of the cases that go to lawsuits, only a small percentage go all the way to trial at the end.
